Employment Law

Navigating Employment Law

Employment law in Ontario is governed by a complex patchwork of laws and regulations. Navigating these laws and regulations can be a challenge and the failure to abide by them can have adverse consequences for you or your business. In many cases, your business can (and should) have in place effective and comprehensive policies to mitigate the risk of becoming involved in an employment law dispute. However, even with robust employment policies and procedures, your business may find itself in a position where it has to defend itself from claims related to a breach of employment law or where it may have to take legal action to protect its rights and interests.

Employment litigation can occur in many different instances, but examples may include the following:

  • Wrongful/Constructive Dismissal
  • Human Rights claims
  • Harassment, Disability or Accommodation issues
  • Breach of a restrictive covenant (i.e. breach of non-solicit, non-compete or confidentiality clauses in an employment contract)
  • Ontario Ministry of Labour complaints
  • Human Rights Tribunal of Ontario complaints
  • Occupational Health and Safety complaints
